This Privacy Policy explains what personal information Vibe Coding Incubator LLC (“VC Inc”, “we”, “us”, or “our”) collects when you use vcinc.ai and our related services, why we collect it, who we share it with, how long we keep it, and the rights you have over it.

1. Who we are and how to reach us

We are Vibe Coding Incubator LLC, a limited liability company organized in Arizona, USA, with its registered office at 14747 N. 97th St., Scottsdale, AZ 85260.

2. What this Policy covers

This Policy applies to the website at vcinc.ai, our marketing and checkout pages at go.vcinc.ai, our newsletter and other communications, our workshops and live events, our membership community and member areas, and the software plan we resell.

It does not apply to:

  • VCI Marketplace at marketplace.vcinc.ai, which has its own Privacy Policy.
  • Third-party platforms you use through us, including the software platform described in Section 8, video conferencing, and any tools you connect yourself. Those providers handle your data under their own policies.
  • Contacts in your own account. If you use the software plan, the leads and customers you load into your account are your data, and you are responsible for them. We handle that data on your behalf, not for our own purposes.

3. Information we collect

3.1 Information you give us

  • Contact and account information: name, email address, phone number, password (stored in hashed form), business or company name, and any profile details you add.
  • Purchase information: what you bought, when, the amount, and the billing details you enter at checkout. Card numbers are collected and stored by our payment processor, not by us.
  • Application and intake information: answers you give in application forms, qualification quizzes, surveys, and onboarding questionnaires, including information about your business, your goals, and your experience.
  • Event participation: your registration details, and if you take part with camera, microphone, or chat active, your image, voice, and messages as recorded in session recordings.
  • Content you submit: community posts, comments, questions, projects, code you share, reviews, and testimonials.
  • Correspondence: anything you write to us by email, SMS, chat, or through a form.

3.2 Information collected automatically

  • Usage data: IP address, browser type and version, device type and identifiers, operating system, the pages you visit, referring URLs, the date and time of your visit, and how long you spend on a page.
  • Cookies and similar technologies: as described in Section 4.
  • Email and message engagement: whether you opened an email or clicked a link in it.
  • Security and access logs: sign-in attempts, including failed ones, for abuse prevention and account protection.

3.3 Information from third parties

  • Our payment processor confirms your purchase and sends us your email, the amount, the item, and transaction identifiers.
  • Advertising platforms may tell us, in aggregate, how our ads performed and may match activity to your interaction with our ads.
  • Referrals and partners may pass on your contact details where you asked them to introduce you to us.

3.4 What we do not collect

We do not knowingly collect special category or sensitive personal information, such as health data, biometric data, precise geolocation, race or ethnicity, religion, political opinions, or sexual orientation. Please do not put that kind of information into free text fields such as applications, community posts, or support messages.

4. Cookies, tracking, and advertising

We use cookies and similar technologies for the following purposes:

  • Strictly necessary. Keeping you signed in, maintaining your session, securing forms and checkout, and remembering consent choices. The site does not work properly without these.
  • Functional. Remembering preferences so your experience is consistent between visits.
  • Analytics. Understanding how the site is used, which pages people visit, where they arrive from, and where they leave, so we can improve it.
  • Advertising and measurement. We run paid advertising and use advertising pixels and conversion tracking supplied by advertising platforms. These allow us to measure the performance of our campaigns and to show ads to people who have visited our site or who resemble our existing audience.

You can set your browser to refuse cookies or to alert you when one is set, though parts of the site may stop working if you do. Where a cookie banner or consent tool is available on our site, you can manage your choices there at any time.

A note on “sale” and “sharing”

Some US state privacy laws, including California’s, define “sale” and “sharing” broadly enough that our use of advertising pixels and conversion tracking counts as “sharing” personal information for cross-context behavioral advertising, even though we do not receive money for it. We do not sell your personal information for money. You can opt out of this sharing at any time. See Section 10.

5. Why we use your information

We use personal information to:

  • create and administer your account, and authenticate you;
  • process purchases, issue receipts, manage renewals, and handle billing questions;
  • deliver what you bought, including workshop access, member area access, community access, and platform provisioning;
  • send you transactional messages about your purchase, your account, and events you registered for;
  • provide support and respond to your questions;
  • send you marketing communications where you have opted in, and measure how they perform;
  • run, measure, and improve our advertising;
  • understand how our site, programs, and community are used so we can improve them;
  • keep the Services safe, prevent fraud and abuse, and protect accounts; and
  • comply with legal, tax, and accounting obligations, and enforce our Terms.

6. Marketing email and SMS

If you opt in, we may send you promotional email and, where you have separately consented, SMS messages.

  • Message and data rates may apply. Message frequency varies. Reply STOP to any SMS to opt out, or HELP for help.
  • You can unsubscribe from marketing email using the link in any marketing message, or by emailing privacy@vcinc.ai.
  • Consent to receive marketing messages is not a condition of any purchase.
  • We do not sell, rent, or share your phone number or SMS consent with third parties for their own marketing.
  • Opting out of marketing does not stop transactional messages about a purchase or account you hold.

7. Who we share it with

We do not sell your personal information for money. We share it only as described here.

We may also share personal information:

  • with service providers who perform functions on our behalf under contract and may only use the information to perform those functions;
  • for legal reasons, where required by law, court order, or a lawful request from a public authority, or to enforce our Terms, investigate fraud or security issues, or protect the rights, property, or safety of VC Inc, our users, or others;
  • in a business transfer, if we are acquired, reorganized, or sold, in which case your information may transfer to the acquirer subject to this Policy or a successor policy, and we will give notice before it changes how your information is handled; and
  • with your consent, for any other purpose you agree to.

8. The software plan

If you purchase the software plan, we provision an account for you on a third-party marketing and automation platform. Two separate things are happening:

  • Your account information, which we handle as described in this Policy.
  • The data you put into that platform, including your own leads, customers, and their contact details. That data is yours. We access it only where needed to provision, support, or troubleshoot your account, or where you ask us to. You are responsible for having a lawful basis to collect and use it, for your own privacy notice, and for honoring the rights of the people in it.

The platform provider processes that data under its own terms and privacy policy.

9. How long we keep it

We keep personal information only as long as we need it, or as required by law.

10. Your rights

10.1 Rights available to everyone

You can ask us to:

  • confirm what personal information we hold about you and give you a copy;
  • correct information that is inaccurate or out of date;
  • delete your personal information, subject to records we must keep by law;
  • export your information in a portable format; and
  • stop sending you marketing communications, at any time.

Note that deleting your account ends your access to memberships, programs, and materials tied to it, and does not entitle you to a refund.

10.2 US state residents

If you live in a US state with a comprehensive consumer privacy law, including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Hampshire, New Jersey, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island, and Nebraska, you also have, where that law grants them, the rights to confirm whether we process your information, to opt out of the “sale” or “sharing” of your personal information and of targeted advertising, to opt out of profiling with legal or similarly significant effects, to limit the use of sensitive personal information, to appeal a denial of a request, and to designate an authorized agent. California residents have additional rights under the CCPA as amended by the CPRA.

To opt out of targeted advertising, use the “Your Privacy Choices” link on our site where available, adjust your cookie preferences, or email privacy@vcinc.ai.

10.3 Global Privacy Control

We honor the Global Privacy Control browser signal as a valid opt-out of sale, sharing, and targeted advertising in the states that recognize it.

10.4 If you are in the EU, EEA, UK, or Switzerland

Our services are directed at users in the United States. If you nonetheless use them from those regions, you additionally have the right to object to or restrict processing, the right to data portability, and the right to complain to your local data protection authority. Where we rely on consent, you can withdraw it at any time.

10.5 How to exercise your rights

Email privacy@vcinc.ai from the address associated with your account. We may need to verify your identity before acting. We will respond within the time set by applicable law, generally 45 days, with one extension where reasonably necessary. There is no charge, unless a request is manifestly unfounded or excessive.

We will not discriminate against you for exercising any of these rights.

11. Where your information is held

We are based in the United States and our providers are primarily located there. If you access the Services from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those where you live.

12. Security

We use commercially reasonable administrative, technical, and organizational measures to protect personal information, including encryption of data in transit, encryption of data at rest with our providers, hashed storage of passwords, access controls limiting employee access to what each role needs, and logging of authentication attempts.

No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a data breach likely to create a risk to you, we will notify you and the relevant authorities within the timeframes required by applicable law.

13. Children

The Services are intended for adults and are not directed to children. You must be at least 18 to use them. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, contact privacy@vcinc.ai and we will delete it.

14. Automated decisions

We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects. Application reviews, refund decisions, and account suspensions are made by people.

15. Links to other sites

Our sites link to third-party sites we do not operate. We are not responsible for their content, privacy practices, or policies. Review the privacy policy of any site you visit.

16. Changes to this Policy

We may update this Policy. When a change is material, we will post a prominent notice on the Services and update the “Last updated” date, and where required we will notify you by email before the change takes effect. Continued use of the Services after that means you accept the updated Policy.
